Booking Terms and Conditions

A. Introduction:

At Mobile Martinis we are totally focused on ensuring our support for your event happens with ease and a professional touch to ensure you create wonderful memories from the event.

We are entering into an agreement, so please read the following terms and conditions carefully.
You must not make any booking unless you understand and agree with the following terms and conditions. References to “us”, “we” and/or “our” in these Booking Terms and Conditions shall mean Mobile Martinis.
By booking our service you are deemed to have agreed to these Terms and Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis.

B. Bookings:

Booking on Behalf of Others
By booking on behalf of another person, you are deemed to be the designated contact person for the booking. This means that you are responsible for making all payments due in connection with your booking, notifying us if any changes or cancellations are required and keeping the party you represent informed.

By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another party is complete and accurate and we will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
Guest Numbers
Guest numbers are confirmed as part of the Booking Confirmation. This is to ensure sufficient staffing and logistics are arranged to provide a successful experience at your event. Last minute changes to guest numbers may incur additional fees.

Booking Deposits
Once we have agreed the details of your event, we will issue you with an invoice for the Booking and the Booking Deposit. Once we receive your Booking Deposit, we have an agreement in place.
With full recognition of your rights under the Australian Consumer Law, all deposits are non-refundable if you change your mind or cancel the event or agreement. You must pay the applicable booking deposit within three business days of the acceptance of your booking or the date cannot be held for you. By paying this non-refundable deposit, you acknowledge and understand that the deposit represents the reasonable opportunity and administrative costs of making your booking.
The Booking Deposit secures your date and time for the event – $100.
Credit Card Payments / Merchant fees
Credit card surcharges of 2.2% will apply when paying by credit card. This is the Merchant fee/Surcharge we incur when taking these payments.

Final Payment
Final payment is due on or prior to your event starting unless otherwise stated.
Recommendations
Please be aware that Mobile Martinis will make recommendations prior to the event to ensure smooth service throughout the event. If these recommendations are not adhered to this may impact the service.
Taxes and Surcharges
Additional surcharges apply for services that are booked for Public Holidays, Sundays and high-volume days such as New Years Eve. Bookings made for the day preceding Pubic Holidays may be subject to a surcharge if our staff are required to work into the Public Holiday to service your event.

C. Events:

Responsible Service of Alcohol
All alcohol for the event will be provided by the host under our BYO Policy. Due to licensing, Mobile Martinis staff will not supply alcohol for the event.
All our staff are trained in the Responsible Serving of Alcohol and are obliged to ensure these laws are adhered to. This includes a legal requirement to refuse service of alcohol to any guest considered to be intoxicated.

Under The Liquor Act 1992, it is an offence to supply liquor to a person under the age of 18 years.

Glassware
We understand that accidents can happen at events and we have an allowance of up to five 5% of breakages per event. Breakages caused by Mobile Martinis staff will not be included in this allocation.
Any “unaccounted-for” glassware or missing glassware at the conclusion of an event will be considered broken.
If at the conclusion of the event, the broken glasses exceeds 5%, the host (you) will incur a cost per item for all unaccounted glassware payable within 24hrs of event conclusion.
Breakages or unaccounted Specialty glassware (eg, Mule Mugs, Tiki Mugs etc) do not have an allowance. Any unaccounted for or broken items will incur a cost per item and will be charged to you and payable within 24hrs of event conclusion.
We will notify you of any glassware that is unable to be located at the conclusion of our service.
Cost per Glass $5.
Cost per Tiki Mug $15
Cost per Mule Mug $15
Photos and Marketing
You consent to us using images of you taken during our service for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, irrevocable license to use such images for publicity and promotional purposes.

D. Cancellations:

Cancellation By Us
If we cancel your service, you can transfer the booking and associated amounts paid to an alternate date or receive a full refund.
Cancellation By You
Subject to your rights under the Australian Consumer Law, all deposits are non-refundable for changes of mind or cancellations by you. A booking is deemed cancelled at the time written confirmation of the cancellation is received. There will be no further cancellation fees, however your Booking Deposit will be forfeited.
Perishable items for the event (such as food and beverages) that have been arranged for the event, will be charged to the client, if applicable and as previously agreed.

E. Other Terms and Conditions:

COVID-19
In the event that government restrictions prevent your booking from going ahead on the date booked for the number of guests booked, your booking deposit is transferrable to a new booking (within 6 months). Any additional payments made can be used as a credit or refunded. If it is possible for your booking to proceed as booked and you wish to change or cancel your booking, this will be deemed cancellation due to change of mind.

Force Majeure (extraordinary event or circumstance beyond our control)
Except where otherwise expressly stated in these booking conditions, we will not accept liability or pay any compensation where the performance or prompt performance of our contractual obligations are prevented or affected by, or you otherwise suffer any damage or loss as a result of force majeure. In these booking conditions, ‘force majeure’ means any event which we, as the supplier of the service, could not, even with all due care, foresee or avoid. Such events may include, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, epidemics, fire, unprecedented traffic events and incidences and all similar events outside of our control.

Liability
We will not accept liability or pay any compensation if you, your property or the property of a third party suffer any damage or loss when transporting our equipment at your direction.

Applicable Law
The laws of Queensland, Australia governs these Booking Terms and Conditions to the fullest extent allowable. Any disputes in connection with our service or these Booking Terms and Conditions must be initiated in the courts of Queensland, Australia.
